WILL - dated 24 February 1766
In the name of God Amen I John Adamthwaite late of Moss in Frostrow but now of Sedbergh Town in the parish of Sedbergh and County of York, yeoman being of souch and disposing mind memory and understanding do make and ordain this my Last Will and Testament in manner and form following, that is to say, I commend my Soul to Almighty God and my Body I commit to the earth to be decently buried according to the direction of my Executrix and my temporal Estate I dispose of as hereinafter is mentioned and expressed, to wit, I Give and bequeath unto my servant Isabel Donnison and her Assigns One clear annuity or yearly rent charge or sum of three pounds of lawful money of Great Britain to be issuing due and payable from forth and out of all and singular my freehold closes or inclosures of land hereinafter devised with the appurtenances from the time of my decease for and during the term of her natural life, to be paid to the said Isabel Donnison or her Assigns weekly by the sum of one shilling at the end of every week and the remaineder of the said annuity remaining unpaid at the end of the year by the weekly payments aforesaid. To be made up and paid in full at the end of every year during her life without any deduction or abatement to be taken thereout upon any account whatsoever with full and free liberty power and authority for her the said Isabel Donnison and her assigns on non payment of the said annuity or any part thereof at the times before appointed to enter into and upon all or any part of the said freehold closes orinclosures of land hereinafter devised with their apputenances and distrain for the same and the distress and distresses then and therefound to take detain impound appraize sell and dispose thereof as as in cases of rack rents or other rents reserved due and payable upon any demise lease or contract for satisfaction of the said annuity and all arrears thereof and all costs and charges touching such distress or distresses any law custom or usage to the contrary in any wise not withstanding. And I further give and bequeath unto the said Isabel Donnison the bed bedstocks and bedding thereto belonging wherein she now lives and also all iron pott one brass pan one frying pan one smoothing iron all the implements and utensils generally used for the making and baking my bread, all the meat drink meal malt and other provisions and all the coals peat turf and fuel remaining and being in my house at the time of my decease and also such other of my household goods as she the said Isabel Donnison shall fix upon and chuse not exceeing the value of twenty shillings to be appraised by any two indifferent persons to be agreed on by and between her the said Isabel Donnison and my Executrix. I give and devise unto my niece Elizabeth Edmondson wife of Thomas Edmondson and to her heirs and assigns forever all those my freehold closes or inclosures of land called or commonly known by the several names of Throslehold, Long Parrock, New Dikes and Willow Parrock situate lying and being at or near Moss in Frostrow aforesaid together with all nd singular the rights hereditaments and appurtenances thereto belonging or in any wise appertaining to have and to hold the same unto and to the only use of the said Elizabeth Edmondson her heirs and assigns for ever subject nevertheless to and hereby made subservient to the payment of the said annuity rent charge or sum of three pounds yearly to the said Isabel Dennison and her assigns at the times and in manner above mentioned. I also give and devise unto the said Elizabeth Edmondson her Heirs and assigns for ever all that free rent of eight pence yearly issuing and payable unto me forth and out of a messuage or dwelling house with the appurtenances situate and being on the east side of Sedbergh Church Yard now the estate of Richard Terry and also all that other free rent of one shilling and four pence yearly issuing and payable unto me forth and out of another messuage or dwelling house with the appurtenances situated and being on the east side of the said Church yard and now the estate of James Inman and also all and singular other my messuages lands tenements hereditaments and real estate whatsoever situated lying and being in the parish of Sedbergh aforesaid to have and to hold the same unto and to the use of the said Elizabeth Edmondson her heirs and assigns for ever. I give and bequeath unto my nephew Edmund Brown the sum of Forty pounds to be paid to him by the said Elizabeth Edmondson within twelve months after my decease provided always and upon this express condition nevertheless that the said Edmund Brown shall and do when thereunto required by the said Elizabeth Edmondson duly execute unto her a good and sufficient release in the law of all claims and demand whatsoever out of in and to all and singular my messuages lands tenements and hereditaments whatsoever with their and every of their appurtenances both freehold and customary situate and being in the parish of Sedbergh aforesaid or in default thereof I do hereby revoke disa.. and make void the legacy of forty pounds so given to the said Edmund Brown as aforesaid and do will and ordain that the same shall never be paid by the said Elizabeth Edmondson anything herein before contained in any will notwithstanding – I do hereby make ordain and appoint the said Elizabeth Edmondson my sole executrix and from and after payment of all my just debts legacies and funeral expences I give and bequeath unto her the said Elizabeth Edmondson all my goods chattels money securities for money and all my personal estate whatsoever not hereinbefore otherwise given and disposed off. And lastly I will and ordain that my present tenant William Cowper shall peaceably and quietly hold and enjoy the messuage land and tenements he now rents under and during the full term agreed between us paying the yearly reserved rent he has paid me for the same And I do hereby revoke all former Wills and declare this only to be my last will and testament In Witness whereof I have hereunto set my hand and seal the twenty fourth day of February in the year of our Lord One Thousand seven hundred and sixty six.

Know all men by these presents that we Elizabeth Edmondson wife of Thomas Edmondson of Dent in the parish of Sedbergh County of York and Archdeaconry of Richmond and Gilbert Wilson of the parish of Sedbergh County of York and archdeaconry aforesaid, innkeeper are holden and firmly bound unto the Right Reverend Father in God William by Divine Permission Lord Bishop of Chester in the sum of eighty pounds of good and lawful money of Great Britain to be paid to the said Right Reverend Father or to his certain Attorney his executors administrators or assigns; to which payment, well and truly to be made we bind ourselves and each of us our heirs executors and administrators firmly by these presents sealed with our seals, dated the nineteenth day of april in the year of our Lord one thousand seven hundred and seventy six.
The condition of this obligation is such that if the above bounden Elizabeth Edmundson executrix of the cash will and testament of John Adamthwaite late of Sedbergh in the county of York and Archdeaconry of Richmond deceased shall and do well and truly execute and perform the last will and testament of the said John Adamthwaite deceased and do pay all his debts and legacys so far as his goods and personal estate will extend and the lawshall bind her if also she do exhibit into Court a true and perfect Inventary of the said deceased’s goods and personal estate and give atrue and just accompt of her acting in the premises when she shall be thereunto lawfully called; that then this obligation to be void or else in force.
